8 and 80 Overtime

Most overtime nonexempt employees are earn overtime after 40 straight hours in a seven day, 168 hour workweek per the Fair Labor Standards Act. There are exceptions to this general rule though.

Nonexempt medical care providers working at medical care facilities may be paid at either the normal 40 hour per workweek basis, or after 8 hours in a workday and after 80 straight hours in a two week period.

There are additional exceptions for goverment workers. However, other than medical workers working in a medical care facility, overtime may not be averaged from workweek to workweek. Read more on the DOL website.
